This Privacy Policy applies to all personal information collected by Your Mediation Australia Pty Limited (ACN 618 790 159) (we, us or our), which trades under the business names Your Mediation and HATify, via the websites located at www.yourmediation.com.au

and www.hatify.au (Websites).

What information do we collect?

The kind of Personal Information that we collect from you will depend on how you use the Websites.

The Personal Information which we collect and hold about you may include:

  • name

  • title or role

  • organisation or business name

  • location

  • email address

  • phone number

  • number of employees

  • login or registration details (where applicable)

  • payment details

  • any other information you voluntarily provide when making an enquiry, registering for a workshop, providing feedback or otherwise communicating with us

Types of information

The Privacy Act 1998 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable:

  • whether the information or opinion is true or not; and

  • whether the information or opinion is recorded in a material form or not.

If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this Privacy Policy.

Sensitive Information is defined in the Privacy Act as including information or an opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record, or health information.

We do not intentionally collect Sensitive Information. However, where Sensitive Information is provided by you in the course of a mediation enquiry, workshop participation or related communication, it will be handled in accordance with the Privacy Act.

Sensitive Information will be used by us only:

  • for the primary purpose for which it was obtained;

  • for a secondary purpose that is directly related to the primary purpose; and

  • with your consent, or where required or authorised by law.

How we collect your Personal Information

We may collect Personal Information from you whenever you input such information into the Websites, register for a workshop or event, submit an enquiry, or provide it to us in any other way.

We use customer relationship management (CRM) systems to store and manage Personal Information collected through the Websites, including enquiry, registration and contact details. This fully covers:

  • Name

  • Phone

  • Title

  • Organisation name

  • Number of employees

  • Notes relevant to workshops or mediation enquiries

  • other information you voluntarily provide when making enquiries, registering for workshops, or communicating with us.

We may also collect cookies from your computer which enable us to tell when you use the Websites and to help customise your experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.

Where reasonable and practicable, we collect your Personal Information directly from you. In some circumstances, we may receive Personal Information from a third party. Where this occurs, we will take reasonable steps to make you aware of the information provided.

Purpose of collection

We collect Personal Information for the purpose of:

  • responding to enquiries

  • providing mediation services

  • delivering workshops and events

  • administering registrations and payments

  • maintaining client and contact records

  • communicating with you about our services, events and business updates

We customarily disclose Personal Information only to service providers who assist us in operating our Websites and delivering our services. Personal Information may also be accessed by maintenance and support personnel acting in the normal course of their duties.

By using our Websites, you consent to receiving direct marketing communications from us where you would reasonably expect to receive such communications. We do not use Sensitive Information for direct marketing purposes. All direct marketing communications will include a simple means to opt out, such as an unsubscribe link.

Security, access and correction

We store Personal Information in a manner that reasonably protects it from misuse, interference, loss, unauthorised access, modification or disclosure.

When we no longer require Personal Information for the purpose for which it was collected, and where we are not required by law to retain it, we will take reasonable steps to destroy or de-identify it. Personal Information held in client files and records is generally retained for up to seven (7) years to meet record-keeping obligations.

Mediation records

Where we are engaged to provide mediation services, notes created for the purpose of the mediation process are managed in accordance with the applicable agreement to mediate which the destruction of notes and is subject to any legal or regulatory requirements,.

The Australian Privacy Principles:

  • permit you to access the Personal Information we hold about you in certain circumstances (APP 12); and

  • allow you to request correction of inaccurate Personal Information (APP 13).

Complaints

If you have a complaint about how we handle your Personal Information, please contact us using the details below. All complaints will be considered by Phyllis Peterson, and we may request further information to clarify your concerns.

If we determine that your complaint is well-founded, we will work with you to take appropriate corrective action. If you remain dissatisfied, you may refer the matter to the Office of the Australian Information Commissioner.

Overseas disclosure

Personal Information may be disclosed to recipients located in Australia.

We take reasonable steps to ensure that overseas recipients handle personal information in a manner consistent with the Australian Privacy Principles.
